Are You Eligible for Reinstatement?
Driver’s License Revoked for Life by Illinois? The Law Has Changed.
Effective Jan. 1, 2016, Illinois has changed its law to eliminate the lifetime ban on driver’s licenses for people convicted of four or more DUI offenses. The lifetime ban affected more than just Illinois drivers — because of the Interstate Driver’s License Compact signed by 45 states, many people who were banned for life in Illinois found it impossible to get a legal driver’s license no matter where they lived or how responsible they became. Now that the ban has been lifted, you may be eligible to have your driver’s license reinstated. It won’t be easy and it will take time, but it could happen.
I can help. I am Alan E. Jones, an attorney who has been helping people get revoked driver’s licenses reinstated for more than 30 years. Whether you live in Illinois or have moved to another state, I can help you navigate the process of getting your license back. Contact me now for a free initial consultation.
If You’re Sober Now, You Can Possibly Drive Again
The rules for license reinstatement after a lifetime revocation are strict. Before you are even eligible to apply, you have to meet both of these conditions:
- You must remain abstinent from alcohol and drugs for three years
- Five years must have passed since the effective date of your license revocation or, if you were incarcerated, five years since your release
In January, people who can show they meet those conditions will be able to apply for a restricted driver’s license with an ignition interlock requirement.
If You Qualify, Illinois Will No Longer Object if You Want a License Elsewhere
If you have tried getting a license in another state after having it suspended or revoked in Illinois, you may know that, before approving one, most states will contact Illinois and ask for a letter of clearance. That letter means that the issues that brought about your revocation have been cleared. With a lifetime revocation, Illinois never considered the issue to be cleared.
With the lifetime ban lifted, Illinois will no longer stand in your way. If you qualify under the new reinstatement rules, we can ask Illinois to provide a “no-objection letter,” which has the same effect.
